You agree to indemnify and hold HealthBuy harmless from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Services or any product.
Contact us first. Most concerns can be resolved quickly. Before filing any claim, you agree to email support@healthbuy.com with a description of the issue and try in good faith to resolve it with us for at least 30 days.
Binding arbitration. If we can't resolve a dispute informally, you and HealthBuy agree that any dispute arising from these Terms, the Services, or any product will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration may be held by video or phone, or in the county where you live. For claims under $10,000, we will pay the AAA filing, administration, and arbitrator fees, unless the arbitrator finds the claim frivolous. The Federal Arbitration Act governs this section.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek court relief to protect its intellectual property.
Class action waiver. Disputes will be resolved only on an individual basis. Neither you nor we may bring a claim as a plaintiff or class member in any class, collective, or representative proceeding.
These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law, without regard to conflict-of-law rules. Subject to Section 15, any court proceeding will be brought in the state or federal courts located in Sheridan County, Wyoming. This does not take away any consumer protection rights you have under the laws of the place where you live.
We may update these Terms from time to time. Changes take effect when posted on this page with a new "Last updated" date. The Terms in effect when you place an order apply to that order. Your continued use of the Services after changes are posted means you accept the updated Terms.
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with the policies referenced in them, are the entire agreement between you and us about the Services. You may not transfer your rights under these Terms; we may transfer ours to a successor. We are not liable for delays caused by events beyond our reasonable control.
